I can not believe all the people here like Echo, Patrick madmax_49 are saying this is a scam. There were a whole load of hoax calls which stopped when they finally arrested the guy. (Shame they could not make the charge stick).

Here in the UK I myself have been a victim of an attempted hoax of someone claiming to be from my ISP and they did come across as being ver convincing. Luckily I am an old sceptic so I got in touch directly with my ISP at great expense and their security section the following day finally confirmed that it was a hoax. Someone who has not encountered scams and urban legends like I have would readily have been taken in.

If anyone has seen the results of the Yale studies in the early 1960′s it is very easy to see why these people would have complied with the voice on the telephone, after all the guy who did the hoax did his homework and did what we call in sceptical circles “Hot Reading”

As for madmax_49, you need to see the video again, an employee did *69 (144 is the UK equivalent) which showed the call did take place, and because of that they were able to ultimatley makee an arrest. Also, by saying the call never took place ignores the actions of Thomas Simms and another male employee who heard the call and refused to go along with the voice. No evidence they were in on a scam on McDonalds!!

If it was a scam, it was a very stupid one, since two of the participants ended up with criminal records and one being sent to jail.

So let me re-iterate, this was not a scam done by Ogborn, Summers and Nix, it was a real hoax. Period.

As for RW comment on why the issue as to why no one heard the physical assault (Sorry but to use a UK expresion, calling a spade a spade, spanking is physical assault), remember busy Friday night, very noisy outside? Also the size of the guy, one suspects adrenaline kicked in with him and the famous red mist hit, which made it brutal.

As for the liability of the McDonalds corporation, I do not know how things work across the pond in the US, but the nearest equivalent legislation I can think of in the UK is the Health and Safety at Work Act. Even if someone is injured, as Miss Ogborn was by Nix, because an employee did not follow the procedures, like Summers, the company is still held liable in a criminal court.

However in the US it seems the bean counters don’t want to pay her a single cent, and I suspect they will win on appeal as they will have deeper pockets to go to higher and higher courts until Mis Ogborn runs out of money for legal fees.

One question I do have about the case, after they realised this was a hoax, did they make her wait for the police to arrive before they gave her clothes back, in another article about this it says.

“Ogborn was so cold she was shaking and so stunned that, as Dockery wrapped her in a blanket, she asked if she had show up for work the next morning. ”

In the video it seems she is fully dressed when the supervisors were in panic mode and just before the police arrived.

I would have thought she would have had to wait for the CSI’s to process her, (photograph the injuries), to avoid contaminating the evidence. But then I suppose the surveilance tape may have sufficed?

Since hearing about this case I have now raised a question about it with McDonalds UK on their Q&A site to find out if they have procedures to alert staff to the dangers of hoax calls of this nature. Just in case someone ever tries to be a copy cat.

This is truley horific, the evilness of all three is both discusting and terrifying. I’ve always mused on the general populace’s tendancy to behave like sheep, but this was a desperate understatement of how ppl can so easily and willingly be manipulated.

I used to work at McDonald’s, and although alot of what is said about working ‘by the book’ is true, what really sets apart the 9-5 worker and the best of the staff, is thinking outside of the box – free thinking.

Sure I know what I’d have done, gone in there and wrapped that poor girl multiple aprons before disconnecting the phone and if required taking out the manager and helpers and informing police via emergency services.

To the commentators above, you have no idea what fear can do to a person, some go awol while others are paralysyed. She looks complicit in certain shots, as part of the stepping up process that lead to that situation – she has no clothes, what do you think shes going to do??? Provoke any situation where she’s seen or worse touched by the guy in an attempt to restrain her?? No of course not, she’s just trying to get-by with the least interferrence before the ordeal ends.

Personally I think McDonald’s responsibility ends at the point at which they have to ensure a safe working environment for staff, and install managers capable of safeguarding the key business values. Having to actually tell managers not to allow non vetted members of the public detain/question staff and not to act upon prank calls and not to perform strip searches etc, just smacks of the ‘HOT WATER’ warning on hot drink cups (even that has some sense, as hot cup that was very recently filled will have a cold outside).

The girl deserves the payout, the manager however should not have got a dime.
